Introduction

By downloading, installing, or using Ready73 (referred to as "the App"), you agree to be bound by these Terms and Conditions. Please read them carefully before using the App.

Ready73 is a native mobile application designed to control Super73 e-bikes via Bluetooth Low Energy. The App is provided free of charge and is available for iOS and Android devices.

Acceptance of Terms

By accessing or using Ready73, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these terms, do not download, install, or use the App.

Intellectual Property

Proprietary Software

Ready73 is proprietary software. All rights to the source code, design, and functionality are reserved. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the App without explicit written permission.

Branding and Trademarks

The name "Ready73", associated branding, the Ready73 logo and visual identity, and custom fonts and design elements specific to Ready73 are protected. You may not use the Ready73 name or branding to imply endorsement, create apps using the Ready73 name without explicit permission, or misrepresent any product as the official Ready73 app.

App Functionality and Changes

We reserve the right to modify the App at any time, add or remove features, update the user interface, and change these Terms. The App is provided free of charge and will remain so.

User Responsibilities

Device Security

You are responsible for keeping your device secure, maintaining control of your device, and protecting it with appropriate security measures.

Safe Operation

By using Ready73, you agree to comply with all local laws and regulations regarding e-bike operation, use the App only when it is safe to do so, not use the App while actively riding your e-bike in motion, follow all traffic laws and safety regulations, and wear appropriate safety equipment when riding.

IMPORTANT SAFETY WARNING: Do not interact with your phone while riding. Pull over to a safe location before adjusting bike settings. Using your phone while riding is dangerous and may be illegal in your jurisdiction.

Bike Modifications

You acknowledge that Ready73 can only control settings that are already available on your bike. The App cannot reprogram your bike's firmware or remove factory speed limits. Any modifications to your bike's controller or firmware are done at your own risk and may void warranties or violate local regulations.

Compatibility and Requirements

Ready73 requires iOS 16.0 or later (or Android 8+), a device with Bluetooth LE support, and a Super73 e-bike with a compatible Comodule Diamond Display. We do not guarantee compatibility with unsupported OS versions, devices without Bluetooth LE, modified or custom bike firmware, or third-party bike controllers.

Limitations of Liability

Ready73 is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for purpose, non-infringement, accuracy, and availability.

By using Ready73, you acknowledge and agree that we are not responsible for any damage to your e-bike, any personal injury or property damage, battery consumption on your device, loss of data or settings, Bluetooth connectivity problems, consequences of bike modifications or settings changes, violation of local laws or regulations, or accidents or injuries that occur while using your e-bike.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPERS OF READY73 BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

User Assumption of Risk

You expressly acknowledge and agree that using Ready73 to control your e-bike is done entirely at your own risk, you are solely responsible for any damage, injury, or loss resulting from use of the App, and you assume all risks associated with e-bike operation and settings changes.

Indemnification

You agree to indemnify, defend, and hold harmless the developers, contributors, and distributors of Ready73 from and against any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the App, violation of these Terms, violation of any applicable laws, your e-bike operation or modifications, or any injury or damage caused by your use of the App or e-bike.

Data and Privacy

Ready73 does not collect, store, or transmit any personal data. All settings and preferences are stored locally on your device. For complete details, please review our Privacy Policy.

App Updates and Termination

We may periodically release updates to improve functionality, fix bugs, or meet platform requirements. Updates may be required to continue using the App, change or remove features, or update compatibility requirements.

We reserve the right to discontinue the App at any time, stop providing updates or support, or remove the App from app stores. We will make reasonable efforts to provide advance notice of termination.

TestFlight Beta

If you are using Ready73 through Apple's TestFlight program, the App is provided for testing purposes. Features may be incomplete, experimental, or unstable. The beta may expire without notice. Apple's TestFlight Terms and Conditions also apply.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where the developers are located. In the event of any dispute: first attempt informal resolution by contacting us directly, then consider non-binding mediation, and finally binding arbitration. You agree not to participate in class-action lawsuits related to the App.

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

Age Requirements

You must be at least 13 years old to use Ready73. If you are under 18, you must have parental or guardian consent. Additionally, you must be of legal age to operate an e-bike in your jurisdiction.

Geographic Restrictions

Ready73 is available worldwide, but you are responsible for compliance with local laws and regulations. Some features may not be legal in all jurisdictions. E-bike regulations vary by country, state, and municipality.

Changes to Terms and Conditions

We may update these Terms from time to time. Changes will be posted on this page with an updated "Effective Date" and announced in release notes when significant. Your continued use of the App after changes are posted constitutes acceptance of the new Terms.
